ASIC publishes roadmap for digital assets framework reform implementation

[20 April 2026]: With the foundational DAF Act 2026 having passed Parliament and received Royal Assent on 1 and 8 April 2026 respectively, ASIC has released an 18-month roadmap for implementing the new regime.

Background


The landmark Corporations Amendment (Digital Assets Framework) Act 2026 ("DAF Act 2026") passed Parliament and received Royal Asset on 1 and 8 April 2026 respectively. The Act will come into effect on 9 April 2027.


On 20 April 2026, ASIC released its roadmap for implementing the new DAF regime - including operationalising a licensing and regulatory framework for Digital Asset Platform (DAP) and Tokenised Custody Platform (TCP) operators.


Key activities and milestones under the Roadmap


  • Months 1 to 6: Will see: stakeholder roundtables and discussions; the establishment of an industry advisory group; and consultation on regulatory guidance and operational standards. The ASIC Information Sheet INFO 225 class no-action position will expire on 30 June 2026, requiring digital asset businesses to comply with existing licensing requirements.


  • Months 6 to 12: Will see the release of a new Regulatory Guide for DAPs and TCPs well as  setting of standards covering: asset holding; transaction and settlement; and financial requirements.


  • Months 12 to 18: DAP and TCP operators will be able to lodge AFSL applications and operate under regulatory relief until their applications are assessed.


  • Month 18 onwards: Will see full implementation of the new regime, including ASIC supervision and enforcement.
